If you suffer an injury or illness as a result of a work accident during work or travelling to and from work and as a result of negligence by an employer or colleague, you may be entitled to compensation.
Workers compensation covers you for damages such as pain and suffering, relevant medical expenses and loss of income. It can be paid through a government-funded insurance scheme called WorkCover or through a workers compensation insurance policy held by your employer.
Common Work Accidents
Workers compensation schemes will cover almost every injury related to a workplace accident. This includes:
- Strains, dislocations, broken bones and other trauma
- Repetitive strain injuries, e.g. carpal tunnel syndrome
- Blindness and deafness
- Chemical exposure
- Infectious diseases
- Psychological injuries
Making a Claim
To make a compensation claim, your employer must know a work accident has occurred and you have sustained an injury. You should do this even if you don’t think the injury is severe at the time as the full extent of the injury might not yet be known.
A workers compensation claim should then be lodged with your employer who will advise the relevant organisation. You’ll need medical evidence to support your claims. If you take time off work you should begin receiving compensation payments soon after.
If you have sustained a permanent injury, you may be entitled to lump sum compensation for the injury sustained. If the injury you have suffered occurred as a result of the fault or responsibility of your employer or another person, you may also be able to make a common law negligence claim.
